Vision

Key Objectives

Facilitating wider policy aims for the aviation sector through regulation of major airports, recognizing their role in the sector and economy;

Promoting investment in airports and air navigation services and their effective management so that all reasonable demands for airport services are met efficiently.

(iv) Function and duties

In Terms of Section 13 of the AERA Act, the Authority is required to perform the following functions in respect of major airports:

(a) to determine the tariff for the aeronautical services taking into consideration –

(i) the capital expenditure incurred and timely investment in improvement of airport facilities;
(ii) the service provided, its quality and other relevant factors;
(iii) the cost for improving efficiency;
(iv) economic and viable operation of major airports;
(v) revenue received from services other than the aeronautical services;
(vi) the concession offered by the Central Government in any agreement or memorandum of understanding or otherwise;
(vii) any other factor which may be relevant for the purposes of this Act:

        Provided that different tariff structures may be determined for different airports having regard to all or any of the above considerations specified at sub-clauses (i) to (vii);

(b) to determine the amount of the development fees in respect of major airports;

(c) to determine the amount of the passengers service fee levied under rule 88 of the Aircraft Rules, 1937 made under the Aircraft Act, 1934;

(d) to monitor the set performance standards relating to quality, continuity and reliability of service as may be specified by the Central Government or any authority authorised by it in this behalf;

(e) to call for such information as may be necessary to determine the tariff under clause (a);

(f) to perform such other functions relating to tariff, as may be entrusted to it by the Central Government or as may be necessary to carry out the provisions of this Act.

A Committee under the Chairmanship of Shri Naresh Chandra, Former Cabinet Secretary was constituted by the Government of India (vide order F.No.AV.13011/02/2003-DT dated 21.7.2003) to chart a road map for rapidly rationalising and reforming the aviation sector in India. The Committee observed that Airport Authority of India was functioning both, as operator and regulator of airports and air traffic control services. This has an inherent conflict of interest. The Committee recommended for establishing an independent entity, viz., the Airports Economic Regulatory Authority (AERA), to oversee and deal with the natural monopoly and "common user/carrier" segments of airports and air traffic control. Based on the Committee's recommendation, Govt. constituted Airports Economic Regulatory Authority (AERA). It is a statutory body constituted under the Airports Economic Regulatory Authority of India Act, 2008. The AERA was established by the Government vide its notification No GSR 317 (E) dated 12.05.09 with its head office at Delhi.

Procedure followed in decision making process [Section 4(1)(b)(iii)]

(i) Process of decision making/ Identify key decision making points

1. Procedure for Tariff orders

The Authority follows a detailed and transparent process before determination of tariff of a major airport. Multi-Year Tariff Proposal submitted by an Airport operator is scrutinized by AERA with respect to various factors like Regulatory Asset Base (RAB), Operating Expenditure, depreciation, taxes, service provider at airport and passenger growth etc. AERA publishes a Consultation paper for the information of the public and Stakeholders and invites views/comments on the same. AERA also conducts a Stakeholder's meeting to elicit the views/comments of the Stakeholders. After considering the comments of Stakeholders and exercising due diligence, the Authority determines the aeronautical tariff and issues tariff Order for major airports. The Authority determines tariff once in five years and may if so considered appropriate and in public interest, amend the tariff so determined from time to time during the said period of five years.

2. Procedure for non-Tariff work

        Authority follows the rules and regulations formulated by the Central Government. Channel of submission is as given below:-

AERA has implemented Centralized Public Grievance Redressal and Monitoring System (CPGRAMS) for online receipt and disposal of Public Grievance. Centralized Public Grievance Redress And Monitoring System (CPGRAMS) is an online web-enabled system over NICNET developed by NIC, in association with Directorate of Public Grievances (DPG) and Department of Administrative Reforms and Public Grievances (DARPG). CPGRAMS is the platform based on web technology which primarily aims to enable submission of grievances by the aggrieved citizens from anywhere and anytime (24x7) basis to Ministries/Departments/Organisations who scrutinize and take action for speedy and favorable redress of these grievances. Tracking grievances is also facilitated on this portal through the system generated unique registration number.
